OFFICERS of the 1,000 Men to be raised under Act 33, passed March 13th, 1779.

The Council of Appointment, in their session of May 3, 1779, decided to divide these 1,000 Men into two distinct Corps, but made the appointments without designating to which of the two Corps each Individual officer was to belong.

*(The Minutes of the Council of Appointment for March 21, 1783, say: "Whereas, Andrew Fink, Esquire, agreeable to orders from his Exc'y the Goernor, did actually do duty as Major in the Reg'ts of the Levies for the defence of the frontiers, whereof Marinus Willet, Esq., was Lut. Col., from the 1st day of May to the last day of Decb'r, inclusive but through some mistake, though he was appointed by the council, the Entry thereof is omitted, Resolved, therefore, that the said Andrew Fink be and he is hereby appointed a Major of the said Reg't of Levies accordingly."

His Ex'y the Governor laid before the Council the Returns of the Levies raised on Bounties of unappropriated Lands for the defence of this State in consequence of the different Acts of the Legislature for that purpose, together with such information, as he had received on that subject; In order as the said Levies do not amount to a sufficient number to compose one Regiment on the Continental Establishment it might be determined by the Council which of the Officers had complied with the Terms prescribed by the Laws so as to be entitled to Commissions and his Excellency be thereby enabled to form tliem into an Independent Corps agreeable to the direction of the said Laws - And it being represented to the Council by some of the persons to whom Warrants were granted to recruit for the said service, that they have enlisted and caused to be mustered and delivered within the time limited by Law the number of men requisite to entitle them to Commissions, but have not been able to procure Certificates thereof from the Persons who received and mustered them, Whereupon it is Resolved, that it is as well indispensably necessary to enable the Council to determine in the premises, as to do Justice to such Officers, and obviate all cause of complaint. That Returns be made to this Council by the Muster Master and such other persons as may have received and mustered any of the said Levies of the Men so by them respectively received and mustered, specifying the name of the Recruit, the time when mustered and by whom enlisted and delivered, and also a descriptive Roll by the Commanding Officer of the said Levies noting Deaths, Desertions and other Casualties.

Resolved therefore .... that the issuing of Commissions to any of tlie said Officers, except such as have or shall produce Certificates from the Muster Master agreeable to Law intitling them to the same be suspended till the next meeting of the Council.

Whereas it appears to the Council from the Returns of the Muster Master Jacob Lansingh that not any of the officers appointed to recruit the two Regiments on Bounties of Unappropriated Lands have enlisted and mustered the number of men, which would entitle them to Commissions, agreeably to tlie Acts of the Legislature in that case made and provided, Captain James Cannon, Lieutenants Pliny Moore and Rial Bingham, who have duly enlisted the Complement assigned to them Escepted and Whereas the officers of the Levies raised for the Defence of this State who, on such failures was appointed to recruit for the said Regiments, have increased the number of Recruits for the said Regiments, so as that the same are Equal to five Companies on the Continental Establishment and it is become necessary, that the same be arranged into a Corps and officered accordingly. Resolved, therefore that Job Wright, Jonathan Piercy, Peter B. Tierce, Simeon Newell and James Cannon be Captains of the said five Companies, That Abraham Ten Eyck, Pliny Moore, Rial Bingham, Josiah Richardson and John Thornton be Lieutenants of the said Companies, and that Ichabod Andrews, Witter Johnson, Jesse Hubble, John C. Shaver and Gideon Cowles be Ensigns of the said five Companies-That Moses Willard be Surgeon's Mate, and Elias Van Beenschoten Junior Esquire, Major of the said Corps and their Commissions respectively bear date the first day of January last except those of the Lieutenants Moore and Bingham, and of Captain Cannon, which are to bear date at the time, when they had Compleated their respective Complements of men to entitle them thereto.
